Actually Wade Williams did own the copywrite on the film in questions and MOMA
cancelled the screening rather than pay him. There is NO fair use exemption
for museums. MOMA generally does not pay, because most major studios and
rights holders have an arrangement with them. MR. Williams did not and in
fact that film was showing about 10 days later at the FILM FORUM which was
in fact renting it from him. On rare occasions MOMA has paid, but in
general they do not as most companies allow them to show films at no
charge. It is a fairly unique arrangement due to their long history. I know
of no other institution which has such a deal. Mr. Williams was within his
rights to instist on payment and MOMA prefered to cancel the screening
rather than set a precedent.
